GoTank Terms of Use

These terms apply when you use the GoTank app on an Android phone or Android Automotive car. GoTank is provided free of charge by Forkly ("we", "us"). By using the app you agree to these terms. If you don't agree, please don't use the app.

Price and station data: disclaimer

GoTank shows fuel prices and station details from public government price services and other open data sources (credited in the app under Settings → Price data sources). We don't collect prices ourselves, and we can't check them.

• Prices are for information only. They can be out of date, incomplete or wrong. Stations report their own prices, and sources update at different speeds, from a few minutes to a day.
• The price on the pump is the one that counts. Always check it before you fill up. The app is not an offer, and no station has to honour the price it shows.
• Station names, brands, addresses, opening hours, locations and fuel availability can also be wrong or out of date.
• Price levels, averages, history, savings and the cost of a full tank are estimates made from this data.
• Some sources limit how their data may be used. The app shows it to you for your own, non-commercial use.

The data is provided "as is" and "as available". We give no warranty of accuracy, completeness, timeliness or fitness for a particular purpose, and we can't promise the app or any source will always be available.

Driving safely

Don't operate the app in a way that distracts you while driving. Obey traffic laws and road signs. They always take priority over anything the app shows. Navigation is handed to the map app of your choice, and that app's terms apply to it.

Your data on your device

Your fill-up log, car setup and home location are stored only on your device, and we have no copy of them. They are lost if you uninstall the app, clear its storage or lose the device. Keep your own records of anything you need, for example for tax or expense purposes.

Your account

Use an email address you control and keep access to it. We may suspend accounts used to abuse or overload the service, or to scrape it. You can delete your account in the app at any time.

Acceptable use

Don't use the app or its server to collect data in bulk, get around the rate limits, reverse engineer the service in order to misuse it, or interfere with it in any other way.

Limitation of liability

As far as the law allows, we are not liable for any loss or damage that results from relying on prices or station data shown in the app. This covers, for example, paying a higher price than shown, a detour to a station that is closed or has no fuel, or decisions made from the price history. We are also not liable for losing data stored on your device.

Nothing in these terms limits or excludes liability that cannot be limited by law. This includes liability for intent or gross negligence, for injury to life, body or health, under product liability law, and your statutory rights as a consumer. Where the law of your country makes us liable for slight negligence in breaching an essential obligation, our liability is limited to the damage that was typical and foreseeable when you started using the app.

Changes and availability

We may change, add or remove features, countries or data sources, or stop the service. If we change these terms significantly, we will tell you in the app before the change takes effect.

Law

These terms do not take away any protection you have under the mandatory consumer laws of the country where you live. Nothing here limits your rights under data protection law. See the privacy policy.
